Criminal Trespassing A person commits criminal trespass if they enter or remain on a property without the effective consent of the owner or other person with apparent authority to act for the owner and the person either had notice that the entry was forbidden or received notice to depart but failed to do so. Notice can be oral, posted signs, fencing or other enclosure obviously designed to exclude intruders, etc. In cooperation with the Montgomery County District Attorney's office the "Criminal Trespass Form" was created to assure that a person has been provided proper notice that entry onto a property is forbidden and that this notice is properly documented. In cases where there may be a question as to "proper notification" this form should be used. Download this form, print it, complete it with as much information as can be peacefully obtained and attempt to have the person sign it. If the person refuses to sign the form, list witnesses that can attest to the notification on the back of the form. Be sure to include contact information for witnesses. Once completed, send the form to the Conroe Police Department so that it can be properly filed for retrieval.
